1. Agreement to Terms

By accessing or using the IgnisTrack Door mobile application ("App") and related services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Services.

These Terms apply to all users, including individual users (engineers, surveyors), company administrators, and trial users.

2. Definitions

• "IgnisTrack", "we", "us", "our" refers to IgnisTrack Ltd
• "User", "you", "your" refers to the individual or entity using the Services
• "Company" refers to an organisation using IgnisTrack for their fire door inspections
• "Survey" refers to a fire door inspection record created using the App
• "Content" refers to all data, text, photos, and materials uploaded to the Services

3. Description of Services

IgnisTrack provides:

• Fire door inspection and survey tools
• Offline-capable mobile application
• Survey data storage and synchronisation
• PDF report generation
• QR code generation for door identification
• Multi-user company accounts

4. Account Registration

4.1 Account Creation

To use the Services, you must:

• Provide accurate, current, and complete information
• Be at least 16 years of age
• Maintain the security of your password
• Accept responsibility for all activities under your account

4.2 Company Accounts

Company administrators may:

• Invite engineers to join their company account
• Access survey data created by company members
• Manage user roles and permissions

4.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• Notifying us immediately of any unauthorised access
• Ensuring your account information is accurate

5. Subscription and Payments

5.1 Free Trial

New users receive a 14-day free trial with full functionality.

5.2 Subscription Tiers

5.3 Payment Terms

• Subscriptions are billed monthly in advance
• Payments are processed through Stripe, a secure third-party payment processor
• All prices exclude VAT (added where applicable)

5.4 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

• You will be charged the then-current subscription rate at each renewal
• We will send a reminder email 7 days before each renewal
• To cancel auto-renewal, go to Subscription settings in the web dashboard before the renewal date
• Cancellation takes effect at the end of your current billing period

5.5 Trial Expiration

After trial expiration without subscription:

• Account enters view-only mode
• You can view existing data but cannot create new surveys
• Data is retained for 90 days before deletion

5.6 Cancellation and Refunds

• Cancel anytime from the web dashboard (Settings > Subscription > Cancel)
• Access continues until the end of your current billing period
• No refunds are provided for partial months or unused time
• If you believe you were charged in error, contact support@ignistrack.com within 14 days

6. Acceptable Use

6.1 You May:

• Use the Services for legitimate fire door inspection purposes
• Export your data in supported formats
• Share access with authorised team members

6.2 You May NOT:

• Share login credentials with unauthorised persons
• Use the Services for any unlawful purpose
• Attempt to gain unauthorised access to our systems
• Upload malicious content or malware
• Reverse engineer or decompile the App
• Use automated tools to access the Services
• Resell or redistribute the Services without permission
• Misrepresent your identity or affiliation

6.3 Personal Data in Content

When uploading Content that includes personal data of others (e.g., photos showing individuals, names in notes), you must:

• Have appropriate legal basis or consent to process that data
• Comply with UK GDPR and applicable data protection laws
• Not upload sensitive personal data without explicit consent
• Take responsibility for any claims arising from such uploads

You warrant that you have all necessary rights and permissions for any personal data included in your Content.

7. Intellectual Property

7.1 Our Intellectual Property

IgnisTrack and its licensors retain all rights to:

• The App and its source code
• Trademarks, logos, and branding
• Documentation and training materials
• The underlying technology and algorithms

7.2 Your Content

You retain ownership of all Content you upload. By uploading Content, you grant us a limited licence to:

• Store and process your Content
• Display your Content back to you
• Include your Content in generated reports
• Create backups of your Content

7.3 Feedback

Any feedback or suggestions you provide may be used by us without obligation to you.

8. Data and Privacy

8.1 Data Processing

We process your data in accordance with our Privacy Policy.

8.2 Data Ownership

• Survey data belongs to the Company account under which it was created
• Individual users creating surveys on behalf of a Company do not own that data
• Personal trial users own their data until joining a Company

8.3 Data Retention

Fire door survey records are retained for 7 years minimum to comply with UK fire safety regulations.

8.4 Data Export

You may export your data at any time via the web dashboard in CSV, JSON, or PDF format.

10. Limitation of Liability

10.1 Exclusion of Damages

To the maximum extent permitted by law, IgnisTrack shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, or data
• Business interruption
• Regulatory fines or penalties
• Third-party claims

10.2 Liability Cap

Our total liability for any claims arising from the Services shall not exceed the amount you paid to us in the 12 months preceding the claim.

10.3 Exceptions

Nothing in these Terms excludes liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded by law

11. Indemnification

You agree to indemnify and hold harmless IgnisTrack, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload to the Services
• Your failure to comply with fire safety regulations

12. Termination

12.1 By You

You may terminate your account at any time by:

• Deleting your account in the App (Profile > Delete Account)
• Contacting support@ignistrack.com

12.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Fail to pay subscription fees
• Engage in fraudulent activity
• Create risk or legal exposure for us

12.3 Effect of Termination

Upon termination:

• Your access to the Services will cease
• Your data will be retained for 30 days (for account recovery)
• Survey data may be anonymised and retained for regulatory compliance
• Subscription fees are non-refundable

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Email to your registered address
• In-app notification
• Notice on our website

Continued use after changes constitutes acceptance. If you disagree with changes, you must stop using the Services.

14. Governing Law and Disputes

14.1 Governing Law

These Terms are governed by the laws of England and Wales.

14.2 Jurisdiction

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14.3 Dispute Resolution

Before initiating legal proceedings, you agree to attempt resolution by contacting us at support@ignistrack.com.

15. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and IgnisTrack.
• Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
• Waiver: Failure to enforce any right does not constitute a waiver of that right.
• Assignment: You may not assign your rights under these Terms. We may assign our rights to any successor.
• Force Majeure: We are not liable for failures caused by events beyond our reasonable control.
